The principle of freedom to compete is so deeply entrenched in our law that the Supreme Court of Appeal has recently stated that in general it’s neither unlawful nor morally unacceptable to cause the economic ruin of your business rivals (Medscheme Holdings (Pty) Ltd v Bhamjee 2005 (5) SA 339 (SCA) at 346).

But it’s not a free for all - competition must be lawful...

Many clients are requiring proof of a company’s policies around the giving and receiving of gifts to ensure it has an ethical view in this regard. It isn’t unusual for companies to have to supply this policy as part of their tendering procedure.

The State of the Nation address by President Jacob Zuma last night was very optimistic and grand. 2011 was tipped to be the year of job creation. More infrastructure, more jobs, more telecommunication, more schools and greater investment for business- this is what Mr Zuma promised us.

No doubt the Labour Departments at the Blue Bulls Company and SARU are waiting for the 12 ‘o clock announcement with bated breath.
