It seems Government has back-tracked a bit with regards to its stance on the labour broker issue. Although Labour Minister Membathisi Mdladlana was loudly calling for outright bans last year, the powers-that-be have realised this is neither practical or logical. However, the consensus is that the industry does need to be regulated…

Labour brokers need an industry body with an enforceable code of conduct

According to an article written by Joe Mothibi (Director of Deneys Reitz Attornies) in the Financial Mail on the 26th of March, the current labour broking situation needs increased scrutiny from the law if it hopes to continue unchallenged. The industry will achieve this through greater regulation:

“We already have the necessary legislation, but the problem is lack of effective monitoring and enforcement. More effective use should be made of existing resources such as labour inspectors and similar institutions. A law does not enforce itself. It must be backed up by meaningful resources. Even if you banned labour brokers you would still need enforcement, otherwise the problem will go underground.”

Many people's concerns over the system have originated from the general view that labour brokers don't care as much for the safety of their staff as employers who use the services of permanent workers. Hopefully, if a body exists to regulate the conduct of labour brokers, it may go a long way to increasing the level of safety these employees can benefit from.
