Casual labourers – if they're injured you must report it

Dear reader,
If you work in a building with more than one level, how do get your office windows cleaned?
If you hire some ladders and use casual labourers to clean them – beware, it could be a health and safety hazard waiting to happen.
I got this question from Paul this week:
Question
I collected four people off the street to clean windows at the office. One person fell from the second floor and died. Must I report this incident?
Answer
The casual labourer (your window cleaner) is your employee for the duration that he works for you, even if it’s only for a few hours. He is entitled to the benefits provided by the COIDA if injured on duty.
Casual labour includes volunteers as you’re deriving benefit from their efforts, even if you’re not paying them!
Tip:
When using casual labour, make sure they understand the hazards of the job and are provided with the appropriate training, tools, equipment and personal protective equipment to enable safe work (OHSA Section 13; Duty to inform).
