Dear reader,
I’m sure you heard the news last Thursday of the explosion at the Benoni scrap metal factory. Apparently two gas cylinders exploded, injuring five people, three critically.
A full investigation is underway, but chances are it could have just been a very unfortunate accident. But what if it wasn’t? What if the employer failed to fulfill his five employer obligations? If you handle any explosives in your business, you have five NON-NEGOTIABLE obligations…
5 employer obligations in an explosives factory
1. Ensure you license your explosives workplace (Regulation 4(1), Explosives Regulations, OHSA)
2. Ensure supervisor oversees any work your staff performs in the danger area. He must be someone who has the knowledge and experience necessary to assess the hazards (Regulation 12, Explosives Regulations, OHSA)

What if it was the employer’s fault?
If the investigators prove the Benoni explosion happened because the employer was negligent, he could be liable for a R100 000, two years in jail, or both!
