Welcome to this week’s Labour Bulletin.
Have you loaned an employee money and now he refuses to pay you back? In these tough times even the tiniest bit counts and you have every right to claim your money! However, you can’t just deduct the full amount from his salary at the end of the month.

Question
What does the law say about "confidentiality of salaries?"
Are employees entitled to know how much their colleagues are earning, even if they’re in the same position and have worked for the same amount of time?
Can my employee accuse me of discrimination as far as salaries are concerned?
Answer
Every employee has the right to discuss his conditions of employment with his fellow employees or any other person (BCEA). Therefore, employees can discuss their salaries with each other.
An employee can claim you’re discriminating if there are pay disparities between employees of the same level and they’re based on one or more grounds of discrimination (Section 6 of the EEA) or there’s no legitimate basis for the differences.
