Read on to find out exactly what each toolkit contains…
Toolkit 1:
GRIEVANCE AND DISCIPLINARY PROCEDURES AND FORMS
These 28 ready-to-use letters, documents and policies will ensure you always have a watertight grievance and disciplinary procedure… even when dealing with a strike. It includes a disciplinary code and a 12 page chairman’s checklist, which is crucial in a disciplinary hearing to make sure all the points have been covered.
This toolkit is divided into three sections:
Disciplinary procedures and forms
Don’t become a statistic and be one of the hundreds of employees that end up at the CCMA for dismissing an employee incorrectly
Use this Disciplinary code (which are divided into minor, moderate and serious) and the action recommended in the table e.g. for refusal to obey a legitimate instruction you can go straight to a disciplinary hearing. However, if your employee arrives at work late you will need to issue a written warning, second written warning, final written warning and then have a disciplinary hearing.
Remember: All warnings must be kept on file for as long as the individual is employed. Warnings are cumulative. So if an employee gets a written warning and commits the same offence again within the six month period the next step of disciplinary action can be taken.
Is your chairman covering all the key points in your disciplinary hearings?
Follow this checklist to make sure you have chaired the disciplinary hearing correctly and covered all the correct points.
Dealing with strikes
Strikes can result in loss of productivity, angry customers, financial losses, injury, damage to property and soured employee relations. Make sure you follow the correct procedure when issuing warning documents for a strike, or else you could end up with an unfair dismissal case a well.
Grievance procedure
Follow a legally correct grievance procedure and use the correct documentation every time.
Use this grievance procedure to put in your employee/company manual. This will ensure your staff understand your companies procedure when a grievance is lodged.
You only pay: R549 (incl. VAT)
Toolkit 2:
EMPLOYMENT CONTRACTS, RECRUITING AND INDEPENDENT CONTRACTORS
Make sure you use a legally correct recruitment procedure and updated employment contracts in your company to avoid legal liabilities.
There’s a fine line between determining whether someone is an independent contractor or an employee. Don’t get caught out. Use this independent contractor policy and checklist to ensure you get it right every time!
This toolkit is divided into three sections:
Employment contracts
Are your employment contracts 100% up-to-date?
You can’t run a business without proper employment contracts. Use these templates for wage and salary earners and non-permanent employees.
By using a limited duration contract, when the assignment comes to an end, the individual will have no further recourse against you, as you didn’t create any expectations of permanent employment to the individual.
Recruitment
The key information every employee file should contain to safeguard your company against wrongful discrimination and negligent hiring suits.
From job application and interview evaluation forms to 18 questions you are legally allowed to ask in an interview.
Are your new employees aware of all your company procedures?
Use the employee orientation checklist as an effective tool to ensure all important employment practices are communicated to new employees.
TIP: Keep this document on file to demonstrate that the employee was briefed on all employment procedures if you ever end up at the CCMA or Labour Court.
Independent contractors
Use this checklist and policy to determine if someone is an independent contractor or not.
Remember: These days there is a very fine line between a so called independent contractor and an employee. So caution is of the utmost importance when making this determination.
You only pay: R449 (incl. VAT)
Toolkit 3:
COMPANY POLICIES AND PROCEDURES
These 34 pages of documents and forms will ensure you follow correct procedure and have all the relevant documents on file in case a dispute arises.
This toolkit will help you to:
- Recover money from a company loan, once a staff member resigns by using the acknowledgement of debt document
- Calculate your overtime and rates of pay correctly, by following our guidelines and calculations in accordance with new legislation
- Make overtime work easier by asking your employees to sign an overtime agreement when they start working for you
- Deduct money from employees salaries correctly. Implementing this payment deduction authorisation policy, which explains what you can and can’t deduct
- Comply with the Basic Conditions of Employment Act by giving every employee a certificate of service on termination of employment
- Combat your unpaid leave problem by implementing an unpaid leave policy
- And much more…
This is how to avoid record-keeping and paperwork mistakes that can expose your company to legal liability.
You only pay: R349 (incl.VAT)
Order now to ensure your employment contracts and company polices and procedures are watertight.
